Been following all of this. Can someone explain the upgraded kidnapping charge? Not arguing any of it. Want to understand what information may have changed to kidnapping and additionally, deciding to charge the 17 year old as an adult.

BATON ROUGE, La. (WAFB) - A grand jury on Wednesday, Feb. 22, indicted a teen for two counts of rape and one count of kidnapping in the Madison Brooks case and the court has released his name.

Court documents show Desmond Carter, 17, of Walker, has been formally charged with the first-degree rape, third-degree rape, and kidnapping of Brooks on Jan. 15. His picture has not yet been released.

He will be charged as an adult, prosecutors said. Carter was initially charged with third-degree rape upon his arrest.




Brooks was standing in a dark portion of Burbank Drive near Pelican Lakes Parkway around 3 a.m. on January 15 when she was hit by a vehicle driven by a ride-share driver. Brooks later died at a hospital.


For those 'working on this': go back and look at the video out of the front of Casen's (his mom's?) Toyota as Madison is exiting the vehicle.

You can see a truck moving by about 100-200 yards away and see a building.

That is NOT across the street from Pelican Lakes.

So where exactly was the video made?

Defendants are lying about it so must be a reason.

Kidnapping - "we will take you home" and instead they take her (remember she's intoxicated .319 and incapable of consent) somewhere to rape her. Then drop her off... we have no idea where but near where she died.

It's a major felony and it opens the door for manslaughter for Casen who is on video (?) "Get out! "Get out!"

The two rape charges. One is First Degree (life in prison sentence is possible) and other is Third Degree.

It's a major upgrade of all the charges.

Public defender? Time for "let's make a deal..."

Thanks guys. Praying for total justice for Madison. May her family find some peace in such an unfathomably painful situation. I wouldn’t know how to go on living.

44.1. Second degree kidnapping

A. Second degree kidnapping is the doing of any of the acts listed in Subsection B of this Section wherein the victim is any of the following:

(1) Used as a shield or hostage.

(2) Used to facilitate the commission of a felony or the flight after an attempt to commit or the commission of a felony.

(3) Physically injured or sexually abused. For the purposes of this Paragraph, "sexually abused" means that the victim was subjected to any sex offense as defined in R.S. 15:541.

(4) Imprisoned or kidnapped for seventy-two or more hours, except as provided in R.S. 14:45(A)(4) or (5).

(5) Imprisoned or kidnapped when the offender is armed with a dangerous weapon or leads the victim to reasonably believe he is armed with a dangerous weapon.

(6) Used to facilitate the commission of a simple escape or an aggravated escape, including a simple escape or aggravated escape from either an adult or juvenile correctional or detention facility, in violation of R.S. 14:110.

B. For purposes of this Section, kidnapping is any of the following:

(1) The forcible seizing and carrying of any person from one place to another.

(2) The enticing or persuading of any person to go from one place to another.

(3) The imprisoning or forcible secreting of any person.

(4) The forcible seizing of any corrections officer or any other official or employee of an adult or juvenile correctional or detention facility for any period of time whatsoever.

C. Whoever commits the crime of second degree kidnapping shall be imprisoned at hard labor for not less than five nor more than forty years. At least two years of the sentence imposed shall be without benefit of parole, probation, or suspension of sentence.

Acts 1989, No. 276, §1; Acts 2021, No. 484, §1; Acts 2022, No. 173, §1.

I bolded the relevant parts. She was enticed to come with them by them offering her a ride home and subsequently committed a sexual assault against her.

And let's be real here, they likely didn't offer her a ride home because they wanted to be good Samaritans and make sure their fellow citizen made it home safe. They saw a possible opportunity to get their rocks off. It's funny they lost interest in getting her home safe after Kaivon and Desmond got done having their fun.

It will be interesting to see if the 4 idiots and their lawyers submit anymore incriminating evidence against themselves.

So far this has been the pattern. When they get in a bind with more charges, they further incriminate themselves with their new submitted evidence.

Maybe this is a new strategy that their cracker jack top notch lawyers have come up with.

The link does not say that anyone was indicted for kidnapping yet.

From the article:
