The justice system is generally fair. No they may not get it right all the time, but it is reliably fair.
If we're doing EQUALITY under the law, we don't care about your race, sex, religious belief, sexual orientation, your fashion sense, where you came from or how you got here. If you commit first degree murder, you will be arrested and spend the rest of your life in prison. That's equality.
EQUITY is different. Equity says that "yeah, we know that young black men might commit most of the murders in New Orleans and Baton Rouge, but it's still not fair to have so many black men in prison. So we need to put more white men in prison or stop prosecuting black men in order to make things equal".

Sure, but he stayed put until the acts were done and I would guess the area was secluded enough so they wouldn't readily be seen by passer-by's.

Even so no one in that area would give two shits about some bodies thumpin in the back of a vehicle if they could even see in the vehicle.
I'm having a hard time imagining the two guys in the front just sitting there chilling quietly while their buddies raped a passed out girl in the back seat for a long period of time. I could be completely wrong but I imagine a bit more of a chaotic scene with drunk obnoxious teenagers that didnt last long (a few minutes) until the driver was like frick this non sense.

I saw a picture of Carver and his family. It looks like he comes from a decent family. I can only imagine that his parents are leaning on him heavily to tell law enforcement everything he knows and to be 100 percent truthful. I can imagine his parents telling him "we told you to stop hanging out with them in the first place. We knew they weren't Nothing but trouble!"
I'm sure they have read him the riot act by now.

By the time they talked to police, any alcohol they consumed would have worked its way out of their system. From the evidence we have, they were sober enough. At least sober enough to get an erection and perform sexually

How would their BACs invalidate anything? I think the affidavit states that the driver was interviewed at ~6:00p on the 15th or 16th. That was the first time he was seen by law enforcement regarding this incident. There was no reason to do a BAC test at that time, but if they had, why would it invalidate his testimony?

We can't know unless they were taken at the time. Kaivon and the 17 year old were sober enough to perform sexually in the back of a cramped car in the dark and then sober enough to wait outside the car while the other finished.

It's a moot point. We can't go back in time and do a BAC test at 2:50a on the morning of the 15th. It doesn't matter how much or little any of them had to drink at that time. Regardless of how drunk they appear or don't appear, it's not quantifiable. The video, if any, won't matter. Maybe they're drunk, maybe they're just inarticulate. Maybe they're just borderline Forrest Gump. There's no law against being stupid.

Indeed. The only way that's at all practical for semi comfortable sex in a backseat is if the female is on top. That would also "look" less like a rape. Of course we have no idea how they were positioned.
