Maybe so. I didn't see a picture of his family. But I just don't think "decent" describes someone that would be a party to what happened. At the very least, "decent" people don't drop a highly intoxicated girl off in a dark area in the middle of the night and just drive home.

And that address may be right. But given the physical features and the description, I think it’s just a placeholder or an approximate address.
I think the program they use requires an address, even if just approximate.

Possible either way. We are all just spitballing here but I guess my point was if she seems more in control of what was happening in the back seat then the appearance/perception of rape could be less.

I have...and in pretty large 80's sedans back seats. And its not comfortable, at least in my experience any other way than girl on top. Perhaps for shorter folks its different.

What is the legal line of BAC to be considered too drunk to consent? I understand there is none.
The law? what law are you referring to?
Statements..what statements proved a rape occurred or in your opinion leans heavily towards the opinion one occurred?

I think this is going to be a massive problem for the prosecution since the poor girl is gone. There is no witness. I am 100% convinced they raped her but is there evidence?

The jurors will have to assess the fact patterns. Right now with what we've been presented I'm not convinced that these these men are all, beyond a reasonable doubt, guilty of the crimes they were charged with committing.
What has you 100% convinced that both men raped her?

Two things: 1) She was too drunk to consent. 2) How many sober women do you know want an anal train in the back of a car? Those two facts have me convinced she was raped.

Possibly but again like you said thats could be hard to prove. Just the BAC at her time of death doesnt convince me. Some folks are near comatose at that BAC while others can converse and operate a car (not safely). Also is it your opinion that if a man has sex with woman who is drunk that its automatically considered a rape b/c she cant consent? Or is their a certain BAC you find acceptable? See where I'm going?

So is sobriety the issue? that would go back to my previous question. Also I dont recall but was there direct evidence so far that both men had anal sex with her? Or even direct evidence so far that either did? Seems like there would be.

And we never will because intoxication is not a defense to commission of a crime because consumption was chosen - thats first year law school

You are correct that there is no empirical standard.

The law is third degree rape. Consent will be judged by whether she was incapable of understanding the act.

From what we know, the medical evidence is likely to prove this.
And as we all discuss her injuries, if we do further, please show some discretion. People who knew and loved her may be reading here. There is no reason to be graphic.

If she was injured in an intimate act, then the defense is more or less sunk. No one lucidly consents to being physically hurt during sex, much less twice.

I don’t think there is or could be any physical evidence of this. It would have to come from a witness.
I guess one of the accused could take the stand and say it. It doesn’t have the ring of credibility to me.
