To be fair, as this thread indicates, most people havent a clue what .319 bac means. Opinions are all over the place on what someone can or cannot do with an extremely high bac.

We saw all this with the O.J. trial. This expert versus that expert and jury wasn't moved by that evidence.

Police out to get the defendant. She consented. No way she could run like that if she were at .319. Defense will say all that and if the jury is comprised racially as EBR is comprised it'd be difficult to get a conviction without more evidence coming out.

I find it hard to believe these guys didn't video the actual rapes.

The ER would have known the reason for admission, but the lab tech that analyzed the specimen would have only known her name/DOB. Aside from that, they don’t get involved in diagnosis/reason for admission. Keep in mind, OLOL is a zoo now. Do you really think a lab tech has time to keep track of each patient’s diagnosis?

i am certainly not a medical examiner, but i don't see why this would have been mentioned in the arrest warrant if it was not considered pertinent to the case...not everything in the autopsy report would need to be included in the warrant...

So the defense is going to say she was drunk enough to fall off barstools, then she sobered up to cross the street to have consensual sex, then somehow got drunk again to the point of wandering onto a highway with a BAC of .32 on a highly specific lab test.

Or maybe she was just drunk as frick the whole time

Once again y’all are only talking about what the defense lawyer wanted revealed to you through the media

Prosecutors would be happy for the case to move to another venue. Say, north Louisiana.

Baton Rouge or New Orleans would be worst cities for prosecution.

There's a 'stick it to the man' at play with the public on this.

When O.J. was acquitted there were cheers and celebrations. Did they believe he was innocent? No, but it was a way to say "F you" to the man. Ditto this.

Anybody that has sat through an undergrad toxicology class should remember the day where they demonstrate alcohol toxicity. I did the guinea pig during my class (the bastards did it on a Friday for a Monday-Wednesday-Friday class so I didn't get a pass). I fell out at .290 and I was a big boy.

Is it possible a retest, done after the arrest warrant, showed a lower BAC?

I’d almost feel better about that.

My dad was involved in a PI case that happened at a nuclear power plant. One expert witness was a professor of nuclear physics and the other was the former commander of a nuclear submarine. Probably the two smartest people who had or ever will set foot in that courtroom. They each took an opposite position and cancelled each other out.

OJ was straight up prosecutorial malpractice. That won’t happen here. Among other things, there are no cameras in the courtroom.
