How about the videos we haven’t seen of her falling off barstool? Does that qualify as a “stupor”

I’m curious when it was taken. We don’t really know what kind of condition her body was in after being hit by the car. We do know she was kept on life support for some amount of time. But if she had liver damage, how does that impact how it processes her blood? Obviously, it would all be scrutinized in court though I’m still not convinced this ever goes that far.

Fortunately for me, I can say I havent been nor do I know anyone who is an alcoholic (that I am aware of).

Therein lies part of why I just can’t understand.

Never been to an lsu tailgate? Getting to a .31 BAC doesn't take so much as you'd think over a 6-8 hour day of drinking

IMO, that she could walk in Reggie's parking lot is one thing. Some then suggest she wasn't in a drunken stupor. But that has to be reconciled with the fact she walked into an oncoming vehicle whatever her level of intoxication.

She was obviously unaware of her whereabouts and incapable of exercising basic judgments.

Cuts both ways here. If she was a person who didn’t act as drunk as he was, the accused can argue they knew she was drunk but not incapacitated.

None of this is great from the defense standpoint. All I’m saying is don’t think this is an open and shut case.

judge with all due respect you are out of your element here. You clearly know the law better than me, but you are wrong here.

Fermentation isn’t happening within a couple hours of arriving at the hospital. That would only occur in a decomposing body.

As soon as she was hit 911 was called and I would bet she was in the ER within 20 minutes where labs and blood was being drawn.

I'm not a woman, but I can tell you, someone with a BAC around .3 can easily do a lot of things. It's almost obvious with some of these threads who were in Greek life

See above. The body can produce alcohol post mortem.

There may be chain of custody issues. Who knows?

I guarantee if I’ve got this video against a .319, I’m going to attack that reading.

They knew she was drunk. They did not say she was incapacitated. They kind of said the opposite.
