Yeah this is the thing that gets me. The entire defense seems to hinge on the idea that the BAC was wrong and/or she wasn’t really that drunk when the sex happened. But you still have the statements by two of the defendants:

Seems like that’s going to be hard to walk back. So if their video evidence makes jurors think “maybe they couldn’t tell she was wasted,” how does the defense explain their statements after-the-fact that she was, indeed, wasted?
Also - where is the legal line for the defense trying the case in the media? Is the judge likely to step in? I’m starting to wonder whether the defense team actually leaked the Reggie’s parking lot video, not the bar.

Has there been any mention if she continued to drink after leaving the bar with them? Maybe that's why she seemed sober at the time of the video and then an hour later the BAC was .319

I know. But according to the BAC estimator, I would have been at about .29 when I hit the wall.
I know for sure I had alcohol poisoning a few years later after innumerable shots of Jaeger at Fat Harry's. I was in bed for two days after that.

Thought about that.
If she was at .319 at death, and she stopped drinking 1.5 hours earlier, she would have had to have done 8 or 9 shots at once to get to that level (assuming she was about 135 pounds).
The accused may say she chugged a bottle in the car after the sex. Although if that were true, it seems like they would have said it by now.

I guess you could argue that she was still absorbing alcohol, and getting drunker, after the sex. In other words, she chugged a bottle and looked tipsy but was sober enough to give consent, then started to keel over as alcohol fully hit her.
The Reggie's statement that she had not had a drink for an hour before she left makes this a little harder to believe.

curious if that means she didn't buy another drink and closed her tab. Because that is very different than not having another drink.
Not sure how else you can make that claim unless she is clearly not drinking on camera for the last hour.
