Nah, he really believes that stuff.
Damn right I do. It's worked out well for me. I've never once felt like my rights have been trampled on. I've had my day in court when I've needed to and the outcome has always been what it should be.
Constitution seems to have worked out just fine for me.

I'd love to know who the clown was that actually down voted my earlier post. Bootlicking MFer

There's such a thing as right and wrong. You do realize that, right?
The cop was 100% wrong. No doubt about it. End of story. End of thread.
He deserves to get tased for 24 seconds and dropped face-first on the ground. Simple as that.

as I supposed to consent out of fear of being shot or tased to death?
If those were my options, I know what I would choose.

And because it's never happened to you, it doesn't exist. We get it.

Not knowing if the cop was a hot head, you'd literally fear for your life if you declined a cop asking to search your car?
What about your house? Your phone, bank account, internet.... the list goes on. If you are literally that afraid to say no, please explain to me what privacy rights you do have?

Stand up for your rights and risk death?
That's the whole point. Standing up for your rights afforded to you via the constitution shouldn't result in getting your arse beat.

Saying no and resisting being forcibly removed from your car because of your rights (as in this case) are not the same thing.

Is it though? The police had zero authority to detain this kid. He had every right to not cooperate. How is that terribly different from not cooperating when asked to search your car?

I didn't say that anywhere, but thanks.

Never said that either.

Yes.

Having the right to do something doesn't make it the best choice.

You can say no and the cop should understand that you know your rights, but once a cop makes it known to you that he doesn't care about the law or your rights, you cannot win by resisting and are putting yourself in danger.

i dont get why there is always a line drawn in the sand on this board. its either you gotta be 100% on the victims side or 100% on the cops side.
there is fault to go around in this story. the cop is in jail and deserves to be, but the kid could have handled the situation better.
This kind of thinking is EXACTLY the kind of thing that leads you to blaming the drunk girl for passing out and getting raped by the Stanford swimmer.
At some point people need to stop hiding behind "personal accountability" and start placing 100% of the blame on the people who are actually breaking the damn law. If the kid was legally in the clear the entire time, then the officer deserves 100% of the blame. There is no other way around it.
ETA: I should have kept reading as I see someone brought up the Stanford situation a few posts later. Regardless, that kind of mindset should be eradicated.

Whatever happened to "innocent until proven guilty"?
It's not "innocent until you meet a hard-arse with a gun and badge and then act a little guilty so he doesn't end your life."
Idiots.

Serious question- if you are put in a situation like this where there's a blatant illegal arrest, are you legally entitled to defend yourself?

And I am thankful of your martyrdom when you meet and expose a dirty cop.
