It takes a lot of courage and faith to do what Botham's brother did. He's embodying what it means to be a Christian.

First, sorry if I came off as a jackhole. Hank and I have been trying to keep the legal side of the threads clean and I tried to do it on the Breitbart comments last night until my head almost exploded. I just didn't want the thread to spin into hyperbole and in my mind burglary is hyperbolic.
I have been a solicitor and practiced defense so this case split my sensibilities, but I hate special treatment for cops.
I do however feel the verdict was within the range of reasonable there was such a good chance she could walk here even with the jury in place. Her defense team sucked arse IMO. Her testimony prep was bad or maybe she was too dumb to prep.
I also save my outrage for shooting I think are worse that had no consequences. The killing (murder) of Daniel Shaver is some of the most chilling video I have ever seen. Just today the cop that shot the homeowner through his front door in Greenville SC got off with no charges.
In the end I would have given her more time, but I am OK with the sentence. At least she got time (contingent on appeal) and won't be carrying a gun in public again (legally).
Again, I apologize for coming off hard.

I am no Christian but I admit I have much respect for the ones that walk the walk. I have disdain for the ones that claim it but only talk. I believe Bo was a good man and his brother is almost certainly a great man and a better man than I would be. Were it my brother I fear tOT would be talking about me within a week of her release. Not suggesting I am some badass and probably would chicken out but I damn sure would think about it every day.

What his brother said shouldn't affect a judge emotionally. I hope the judge was chewing ice at the time.

Deadly weapon and violent crimes in TX require 50% of the sentence served prior to parole availability.
She will almost certainly walk after 5 unless she goes all Orange Is The New Black.

I think that is what irks me on the sentening the most. If she was to serve every day of that 10 year i would be pretty content, but almost everyone knows she won't.

No one gets parole on their first attempt. She will likely serve 7-8 years. Not the full 10, but she will serve more than 5

Are you in the CJ system in TX? I ask since no jurisdiction I practice in is near 0% on first application.
Her risk level will be the lowest possible and even with murder, it puts her guideline score in the lower half. I can't possibly see them thinking she is any sort of risk on release. Given the circumstances of the crime and her risk score, I would think she would have a really good shot at first parole again I don't practice in TX. I also assume she has a solid support network.

No, but I do practice in TX. Asked a good friend who does criminal law in Texas. Even with her low flight risk and likely good behavior, she likely will not be paroled on first attempt.
In most states she would get paroled on first try, but Texas doesn't parol people the first few years they are eligible

She is still a convicted felon who will have to answer "Yes" to that question on her future job applications. She'll never be able to purchase a firearm or vote. Even once she gets out, her life isn't going to be a cakewalk.

As time goes on and the days get harder and harder for her while in the pen, I hope she thinks back on the compassion of Botham’s brother and uses it to carry on.
Maybe this will help her turn her life around.
