Considering they were fully aware of the restrictions when they purchased the property, I agree. It is pretty unbelievable that they thought they could do this.

Sure, it sounds like they moved this tree and a couple others, displaces some soil on their own property

600k is absolutely unreasonable.

I just read where Dallas moved an oak a short distance and cost 100k. I have seen others costing around there for similar trees. I have personally seen a bill for around 60k just for the Move. If someone is spending that much on a move. A 600k fine is well within reason

How much do you think it will cost to replace 200 years worth of an oak tree, as well as the dozen others? Do you think killing a 200 year-old tree, and merely planting a new one would satisfy a conservation easement?

Homeowners are dumb, now they can pay the cost for full replacement.

I sure hope they can find another 200 year old tree to replace it. I'm sure there's hardly any left.

How much do you think it would cost to get an oak to 200 years, which the easement required to be untouched, and consequently restored? Don't breach the easement, don't have a problem.

This is no different than building too high in a height restriction easement such as near an airport. They breached a contract knowingly, they have to restore.
