They should have no prob in a jury trial. I wouldn't convict them. Banks put the screws to people everyday. frick em.

Friend of mine was a drill bit salesman back in the early/mid 90s. Direct deposit was just becoming a thing.
He had decent money but for a few months, every 2 weeks about 1000 extra was deposited into his account.
Finally he figured it needed to stop, saw he closed the account and switched banks. Bought him a Rolex and never looked back. Lol

Just moving it out of the account can be construed as theft, even if you don't spend the money.

And this couple is on the hook for paying the bank back. They knew it was a mistake and chose to choose prison. Piss on them.
