Yeah, he would have to pay for it one way or the other. Im no lawyer, but I have to think the law would not be in his favor on this one, which would cost even more if he had to pay for a lawyer then eventually be forced to fix it.

This is where my fight would start. The homeowner in the story didn't sign a contract, therefore this quote is bollocks.. right?

Of course the homeowner didn't sign a contract. She had never even talked to the roofing company. They just showed up and took the roof off.
It seems that the contractor's insurance company is refusing to foot the bill because his policy doesn't cover damage due to an open roof. I take that to mean that the insurer views that as a direct fault of the contractor in that his negligence to at least tarp the roof properly and replace it in a timely manner caused the damage. The insurer seems to be saying that the contractor will have to bear the cost of replacing the roof and repairing damage.
Shitty for the homeowner to be caught between two companies that seem to not give a shite about the actual issue.

And what will happen is that this guy will close and then shortly after re-open as AAA Roofing.
Old company is dead and can’t be sued, new company claims they had no connection to the issue.

It would be far cheaper for that dumbass roofing company to fix the damn roof themselves, not waiting for insurance, than to sit on their hands and get drug into court.

This contractor apparently has no business being in this line of work, nor do the employees who didn't at least question removing a likely in decent shape metal roof upon showing up at the job (who doesn't make confirmation with homeowner and require them to be there for at least the start?).
With that said, provided the contractor makes it right in a very timely manner, I think jail time could be spared. In this case, there should be jail time and the owner should be forced to sell or shut down the business. This isn’t a mistake, this was a completely preventable frick up.

Family will get a whole new upgraded house before it’s all said and done if that company doesn’t fix the error immediately.

If the homeowner is wanting quicker results. File a homeowners claim with their HO insurance for vandalism and theft of roof. Get paid less deductible and hire a different roofing company. Their insurance will subrogate against the 1st roofing company for the amount they paid out plus the deductible to be paid to the insured. The homeowner can then sue the 1st roofing company for any damages over and above what their insurance company paid out.

My sister and b-I-l live in Oak Harbor in connected townhouses. He had a brand new roof put on his side after Katrina. B-I-L pulled up to their house a week after only to find a bunch of Mexicans peeling off their brand new roof…

It was when I was in college. The inspector started like a month before I did. And I was there for about 3 months when it became just him and me in the department.
They required people to get a permit if they were building anything on their property, The inspector used to be a contractor and he knew that was just a money grab and that no one would even know if people were building a shop or some type of small structure.
We figured out the women who worked there when we both started was stealing money. Overcharging people, telling them they could only pay in cash and didn't accept checks. Depending on where they lived they couldn't build within a certain distance from the road, but making people pay for building permits is bullshite.
I guess it makes sense in areas where there is a lot of construction going on because it takes time to review everything, etc, but it should be a service that is there to help people. To make sure they are not getting screwed by some shady contractor, determine what flood zone they are in, etc.
There were contractors that would always try to screw people. Most of the time it wasn't anything major, but people were not getting what they paid for so we watched out for the people son.

insurance covers damage from accidents and injuries, not from complete stupidity
10/1 the insurance is 100% on solid grounds to deny this claim since its due to negligence which isnt part of the injury liability coverage
