I doubt that most people would refer to what happened as a "sexual assault." It is similar to calling at 18 year old high school senior fricking a 16 year old high school senior a "pedophile."
I saw a case record with the latter scenario. Girl was a senior, told the kid that she was 17. He fricked her a number of times as she was his gf. Got charged with misdemeanor "molestation of a juvenile." Because of the circumstances, he plead to a $500 fine.
