I feel lucky to live in a house that isn't part of an HOA but has a strong enough home-rule class city that the local code enforcement stays on top of enforcement of tall grass, junk in the yard, etc.

I don't believe we do. Our dues are low but i have no idea what they get used for... it's frustrating

Because right now our HOA serves to deal with cranky boomers when the mail or trash doesnt run on schedule and I have no time for that shite, nor do I have time to reform the HOA from it's current state.

I know I'm lucky, but my HOA is great. Affordable, only care about real issues, staff and maintain our pool, maintain the roads, signage, and landscaping, and host great events for the 4th and Halloween, etc.
They'll get on you about severely neglected lawns apparently, but never heard of it really happening. They did send me a note (not a fine) when I forgot my garbage cans on the street for a week when I went on vacation, which I felt was warranted.
We have some great people on it though. Rich, young, semi-retired Tech CFO is in charge of the finances and he's an awesome guy.

any board will have D&O insurance to cover everyone on the board. You can have a long drawn out legal battle but it's going to be paid for with HOA operating funds, which come out of every homeowner's pocket.
If a homeowner wants to sue the HOA, they better be 100000% certain they're right, in addition to having a ton of their own out of pocket money (and time) to waste on it too.

I’d be curious to know how much of a headache it would be to demonstrate the HOA is fining you for refusing to violate the law.
Wondering if you could sue all of the asshats on the HOA board and in the mgmt company to recoup all of your court costs as well.

Just got ChatGPt to give me the rough points on the legality and authority of HOAs - stuffs not cool (if you get a wannabe dictator as HOA pres)
But I wonder if, when going back and forth over the paperwork, a realtor can sneak in language that explicitly voids HoA authority over them (whether total or for specific things)
