Public colleges and universities can’t ask most applicants about their criminal past under legislation the Louisiana House gave final approval on Tuesday.

Though not part of the governor’s package to overhaul the state’s criminal justice system, House Bill 688 could have a sweeping impact on higher education in Louisiana.

Typically, college applicants are required to check a box indicating if they have a prior conviction. Often that revelation is used to reject the application.

Syrita Steib-Martin, a lab supervisor at Touro Infirmary in New Orleans, did the research that helped Democratic state Reps. Vincent Pierre, of Lafayette, and Ted James, of Baton Rouge, craft the legislation for Louisiana. She pointed the lawmakers to wording used in similar bills being considered in a half of dozen other states.

Based on her research, if Edwards signs the measure, Louisiana would be the first state to take questions about most crimes off college applications, she told The Advocate.

Maryland Gov. Larry Hogan, a Republican, last week vetoed similar legislation that, like in Louisiana, received overwhelming support from legislators of both parties in both chambers. “We should not encourage schools to turn a blind eye to a prospective student’s potentially violent criminal background,” Hogan wrote in his veto message.

quote:

The Education Department also referred to a study at the State University of New York that showed two-thirds of individuals with a felony criminal offense record stopped the application after being asked about criminal justice involvement.

Steib-Martin wasn’t among that number. After checking the box on her first application – and being rejected by the University of New Orleans – the next time around, Steib-Martin didn’t check the box and was admitted with a scholarship.

Same academic credentials, same application form, same identification number – the only difference was the she left off the check mark identifying her as a convicted felon, she said.

At the age of 19, Steib-Martin got involved with stealing cars. A dealership in Tyler, Texas caught some of the gang’s images on security cameras, so they tried to burn down the dealership in hopes of destroying the evidence. Steib-Martin was convicted and sentenced to the federal penitentiary.

She got out in 2009 after nine years in prison.

quote:

“Had I not been allowed to get an education, life wouldn’t have become better for me,” Steib-Martin said.

I don't have a problem with this. There's worse things than someone getting educated post conviction.

Don't know why anyone would have a problem with this. Why encourage recidivism?

Doesn't the governor have to sign off on it first?

What if colleges turn this around and use it as an excuse to jack up fees again?

"Included in your financial statement for the semester is a new background check fee".

No need to ask, just jack up fees for everyone and run background checks as a standard policy.

So she's a felonious pos and she lied on her college application. Sounds like a great person.

As long as violent crimes like murder and rape have to be disclosed, I don't see the problem.

And it should still have to de disclosed on housing applications if a student plans to live on campus imo

I agree that once someone has served their time they should be able to make a future for themselves but a part of me wonders how I feel if my child shared a dorm room with convicted felon.

Because I'd rather not send my girls to a school where a violent offender is roaming the halls.

Call me crazy.

I imagine any fees that would get raised would be at admission. So they add an extra $100 to the application fee per person. I suspect if they did this the legislature would get involved again though.

You don't think it's important information to have that the person applying is a felon? Ok for jobs, but dammit not at school!

Best keep them home safe with you then. If you think the frat boys will treat them "nicely" you might want to re-evaluate their life choices for them.

I was lucky enough to get my peeping tom convictions while already enrolled in college. Fully support this.

What kind of felony? Do you believe all felons are dangers to the public? I mean you can't put the guy growing weed in his backyard in the same category as a serial killer.

I agree with you, but I feel like arson should need to be disclosed

1)Can we please end the "my child" crap? They're in college, they're not children.

2)I see value in disclosing the criminal history of the person you're rooming with. If the person moving in agrees all the better.

there's just a little difference between two drunk college students hooking up (you know, the fratty guy that you wish you were RAPED her!), and some violent criminals finding and raping a girl.

I'll just come out and say it. one is rape, the other is not. my female would agree.
