The FMLA is out of the picture due to 16 employees at my location (must have at least 20 employees for FMLA to be valid).
At your location or is that the size of the company?
It's 50 employees within 75 miles for FMLA

Take your leave and have the surgery. Let your boss pound sand! WIth HIPPA employers aren't allowed to ask many IF any questions regarding medical issues and related medical leave taken. I would schedule the surgery, call in the morning of the surgery and report you are having emergency surgery. I would say no more. Also, under NO circumstance would I quit my job. Make them terminate you. Hang in there brother. Prayers sent your way!
^^^^ THIS THIS THIS
In 2016 I was in the exact same situation. But I got laid off. Lost insurance. No medicaid. Flood. Couldn’t walk more than 3k steps a day without day ending pain. Had to wait 2 years for a replacement. GET IT DONE NOW!!!!

This is the question: If I 'quit' my job, will I still be able to use COBRA to get this hip replacement done?
Don't use COBRA that is insane. Hang in there until december. Quit in December and your work insurance will be good until the end of the month. Because unemployed you will be able to sign up on Obama care in december that will start in January. They ask what your income is and since you are unemployed you can project a low income level just make sure it is above 12,000 dollars so you can get Obama care. If it is below they will put you on medicare. With that low income you will get a crazy low premium and deductable.

Actually, HIPAA don't apply to employers. They are in place to assure healthcare providers and other parties who hold your medical records do not disclose information. There are, however, other laws that prevent employers from asking to many questions (like ADA laws). In my opinion, an employer would be within its rights to ask you about an upcoming procedure if this will affect your work requirement.

My boss has been acting funky about me taking off time lately. I figure boss is going to give me a lot of static and maybe tell me I cannot have an extended leave of absence due to my hip replacement.
Your boss is probably being weird because he thinks you are going to claim it is a workers comp case. At any rate, your boss is well aware that a sure sign of impending retirement is having all surgeries and procedures that you need done….everyone does this.
I don’t have the answer about cobra, but congrats on your upcoming retirement….it is glorious!

I was really surprised how reasonable private Insurance was through all the big players
Cobra is extortion

For a hip?

Just as an aside....I want to add a clarification to everyone saying COBRA is ridiculously expensive (even "extortion"). COBRA is just the full, 100% medical insurance premium. That is what it costs to insure you and your family. The fact that employers pick up a good chunk of the premium, and you have a much smaller out-of-pocket contribution, doesn't mean the health insurance is any cheaper.
I agree with most everyone saying try to NOT go on COBRA, etc., but also trying to put it into proper perspective.
Thank you for your attention.

Just my two cents, I had both done and was back at work in 2 weeks. Similar to your work habits also, 54 years old

IDK what full recovery time is going to be. I could be out 2 weeks, maybe more, you are not really going to know until you cross that bridge.
I have been working on flexibility, cardio and body strength. And dropping these last few extra pounds.
I am just about ready to say 'Damn the torpedo's, full steam ahead' and what happens is what's gonna happen.

Hip replacement is far and away the easiest recovery of the major joints. Even unhealthy patients are back at it in 3 weeks (assuming you’re good about doing your PT). Hell I’ve had farmers working on the farm within a week but they’re a special breed.

Do you not have short/long term disability through your employer?
Posted on 7/26/26 at 7:36 pm to K E V 8 4
I was on COBRA for about 6 months, paid like $530 a month, wasn’t terrible

need to get this done. I am afraid that my place of employment may deny me taking an extended leave of absence.
Do you not have the option to work from home? or is it not that kind of a job?
