Richard is going to pay a shite load of money out to the injured kids for restitution. There would have been no reason for him to leave the scene if he had nothing to hide.

If I’m the parents of the injured, I’m asking for way more than he could possibly have in coverage. Not because I’m greedy but because he fled.
And I’m suing to get him disbarred if that’s at all possible. Essentially, I’m gonna (try to) ruin his life cause he has earned it.

The fact that he rendered aid may let him squeak by on the hit and run. He just quietly ghosted amid the confusion. It was a douche move, but he likely would rather face the negligent injury without evidence of impairment. He gave it some thought IMHO.

I'm not sold on the idea that this guy has to beat the BUI charge. There are plenty of forms of evidence other than a breathalyzer or a lab test. Surely there were people who'd had contact with him throughout the day, and observed his behavior.
I don't even think a BAC over 0.08% has to be shown for a conviction of BUI. It certainly doesn't in GA or MS, unless something has changed.

In Louisiana. The dui statute has “operating a vehicle while under the influence of alcohol” as a catch all that could likely be used to get a conviction based on third party evidence.

Nope, everyone looks at the umbrella as being the real deal. Underlying limits have to be exhausted prior the the umbrella limits being in play. Most of the attorneys i have dealt with carried min liability auto limits.
Also, his homeowner policy may not respond to this act or if they do, he will be non-renewed.

He was in self preservation/ lawyer mode. Very much a sleazebag for leaving injured kids on the lake by themselves. He probably knew he would get a dui charge if he hung around, he almost certainly won’t now and the felony charge will go away if this is his first offense.

I don’t know why you are getting downvoted so hard. I spend a lot of time out there, being on a boat isn’t a big deal during holidays. Sure there are a few areas I wouldn’t pull kids on a tube but to say you wouldn’t be on a boat is funny
