Car wreck/insurance question

OK, tiger droppings lawyers, I was rear ended and my car was totaled. Owed about $11,000 on the vehicle. The other driver drove a very expensive relatively new luxury vehicle. They had insurance through State Farm. Am I going to get fricked here or am I going to be able to get some money to make a down payment on a new car?

What does this have to do with anything?

You provided zero info about your vehicle, so expect zero useful information. The fact you 11k is irrelevant.

You will get your car’s market worth.

If it is valued at $20K, you will have $9K for a down payment on a new car.

Nothing in your post, except being rear-ended, is relevant to your payout. Without injury they are going to give you fair market value for your car. I hope it was worth way more than 11k.

If it was the other drivers fault you’re about to get paid.

State Fraud isn’t going to fight it. They will settle and pay you

Comps are anything from $15,000-23,000. Yes. My passenger did as well.

I had a 2020 work van. Someone ran a light and hit me.
I was paid out more than I owed by $8500.
So I took the $8500 and bought a car and a used sail boat and never replaced the work van.

so, by you’re logic, the other a-hole that hit me and my spouse going 50mph because they were looking at their cell phone, while we were stopped in traffic, is not at fault and I shouldn’t sue them? What planet are you from…
