It will most definitely cut down on frivolous suits, there’s zero doubt about it.

Ostensibly someone with the means to drive a nice car has the means to be properly insured. That’s a legitimate observation for him to make if he’s concerned about getting shorted on his total loss relative to his note.

You took it from there and extrapolated it to an accusatory place.

Good for you for crawfishing it back.

I’m an agent, we pay out BI claims all the time. Any insurance company should pay what they owe, but only what they owe. Otherwise stop bitching about rate increases and also using every opportunity to cash in on accidents. Btw, the key point in your last post is REAL soft tissue injuries.

The key in my last post is state farm doesn’t offer barely shite

I feel I’ve lit a fire. My overall concern is that insurance agencies treat to frick people all the time. I’m relying on another persons insurance at this point not to frick me. It’s very concerning. And to answer any questions about BI, my passenger has very legitimate injuries, but I didn’t bring that up initially because I didn’t want it to cloud the issue…

It may or may not be, but the first inclination to sue is part of the problem.

You know what, you’re right. It’s stunning they’ve been the number 1 insurer for almost 100 years sucking as much as they do.

No relevance.

The thing that matter’s is the amount liability they had. In American dollars.

The next important fact is how much UM did you have ?

Folks need to be loaded with UM in Louisiana.

What you gonna do with 20/40?

I don’t know those low numbers. I carry 750,00 uninsured motorist. You need it.

And that’s a terrible assumption to make when it comes to liability coverage. When it comes to his vehicle, it’s completely irrelevant. He is covered under his own policy and his carrier could subrogate against State Farm.

Or they have the ability to pay an excess if they’re not properly insured.

You’re assuming OP has collision and feels like shelling out his deductible because some other dude was looking down at his phone and State Farm wants to play the float a bit longer.

Showing your ignorance yet again. He owes 11k on the vehicle, he’s required to carry comp and collision.

And you accuse me of assuming things.

Correct, which he would get back through subrogation. Meaning regardless his vehicle will be taken care of. If you don’t trust your own insurer to take care of you, that’s not good.

Which brings me back to the OPs point about owing 11k without initially providing any detail about what the value may be. If ACV is 19-23k, he will be fine regardless of which avenue he pursues on property damage.

Tell me, what percentage of your business is property damage vs BI?

my car was rear ended about a year ago. The other driver had State Farm. My car was totlaled and I was paid the current market value. The adjuster provided me a report that had several used vehicles similar to mine in the area available and the value was similar to the prices for those vehicles.

Good. F'ing ambulance chasers are causing us all to pay higher insurance rates.

Remember several years ago when the legislature overhauled the rules for lawsuits because the insurance companies said our rates would go down, and then all the insurers raised rates instead? I member. Keep lapping up the propaganda.

If there was damage to your car there was damage to your body.
