California DA’s new policy to consider looters’ ‘needs’ before charging them

The new mandate, set forth by Contra Costa County District Attorney Diane Becton, makes it tougher to prosecute looting cases in the county, which sits just outside San Francisco.

Investigators must now consider “was this theft offense substantially motivated by the state of emergency, or simply a theft offense which occurred contemporaneously to the declared state of emergency?,” according to the policy reported by local outlet East County Today.

In making that determination, they must also consider five other factors, including “was the theft committed for financial gain or personal need?”

The new policy comes amid the swell of protests, looting and riots in the wake of police-involved shootings of black people across the country.

Should be fired and disbarred. That isn’t their job. Their job is to prosecute when laws are broken, period.

What every looter "needs" is enough prison time so that when they're released age related diseases/conditions prevent recidivism.

Is that the law? I don’t like DAs and judges legislating from the courtroom no matter where they fall. Their job is to prosecute and judge by the letter of the law.

It’s representatives jobs to write the laws. Come on people.

Agreed, but honestly, who is going to come down on the DA for this? I would bet the only possible consequences he faces will come when it's time for reelection and hell, maybe voters support this. It's still not the way to go about it though if they do support it.
