Anyway, my point is that when you make a definitive statement like you did, stating that the auto insurer will sue the homeowner's (not might, or possibly), misleads people in the way insurance actually works.
In my experience, they will sue (or, if they are members of AF, will go to arbitration).

Last post on page one...I have always been pretty nice to Nurse. Not sure why she would do this to me. I could have used that money...and Festus could have prodded it JUST a bit for me...I thought he and I were like brothers...Me just a little taller and younger...
sigh

In your experience, the neighbor's auto insurance carrier will sue the same person's homeowner policy for liability? So the insurance carrier will sue their own insured?
That's your experience? Hmmmm...
Do you mind me asking, what do you do for a living, and where do you operate? I'm being serious.
And for the record, read your own response to me. This was your original statement. Direct, no qualifications:
quote:
Then the car insurer will sure lsunurse's homeowner's insurer to recover what it paid, and the car owner's deductible.
When I questioned you, instead of saying you misspoke, you place 3 different qualifiers on your response (none of which were discussed or proven):
quote:
If the supports were rotten
quote:
or facially insufficient to prevent the fall
quote:
there could be negligence for failure to exercise reasonable care.
Now, you're back to no qualifiers. Just in your experience, they will sue.
(qualified again now with, "in your experience).

My understanding is that the cactus was on lsunurse's property.

I see nothing has changed since I left Scottsdale
I was there about a month ago. It was 121 degrees at 4pm. 100 degrees at 11pm.
No thanks.

Why are you renting? You should buy.

It's karma playing out, imo.

Saving up for a down payment right now. Both my husband and I have never owned a home.

Again....the monster cactus was NOT in my yard....was in my neighbor's yard, fell in her yard into her car.
She has the same company for her auto and homeowners policies.

OK. Thanks.
Festus, et al, forget everything I said.

Saguaros are highly protected by AZ law so I think you have to go through proper steps to remove them.
Good thing it didn't fall on a person, then.
"He's bleeding profusely, but if we can get him out from under the cactus, we can save him."
"Yeah, just go ahead and call the coroner."

and people say that people that live in hurricane areas are stupid, you actually pay to put that ugly arse weed by your house
Yeah because a cactus falling on one house is the same as a huge storm causing damage to many homes.

Isn't it a federal crime to mess with those things? I think you have some splainin to do, nurse.

Course...she did just sell her home so I would be curious how that plays out with insurance, etc.
Unless fire, lightning caused it to fall, there probably is not coverage under her the homeowner's policy for the cactus. Her car insurance would cover the car.

Cactus sucks. they are complete pricks.

The only possible coverage then would be under the auto policy, and ONLY if there's full coverage. An auto policy for liability only would cover nothing in this event.
there's "full coverage" on that new lexus... blee dat. she didn't pay that thing in full.
