I would imagine passing under a bridge with the crane in the up position would be pretty negligent. Unless they can show it was stuck or something and they took steps to try to stop the boat.

What part of "hitting an immovable structure with a known minimum height" isn't gross negligence?

Seems to me that "make sure you can fit under the bridge you're trying to go under" should be pretty high up on the checklist.

Whatever insurance they have likely wouldnt cover the cost of fixing this

I'm so thankful I don't have to drive an 18 wheeler for a living.

It's so easy to take for granted not worrying that your vehicle is too high for a bridge.

An earlier thread on the topic indicated this was a rather large company with a lot of operations and tugs, so these sorts of things are just going to happen, due to volume.

So if it is indeed a big company, plenty of insurance, or plenty of lawsuit.

Donaldsonville use to offer a ferry, wonder if the dock and all could be replaced/fixed quickly and they could get that running by the end of the month.

If they are indeed a substantial owner, there is the possibility they either have their legal liability insurance through a P+I club which would effectively be an unlimited limit of liability. If they have it through traditional marine insurance markets, I guarantee they have more than sufficient to cover this by the time their Umbrella policies are exhausted.

As for the constant referrals to the Jones Act, that covers way more than limits on liability. More importantly to most, it provides the ability for employees working over water (e.g. crew, stevedores, offshore construction, etc) to be able to sue instead of being limited by Workers Compensation type laws.

The Jones Act also prohibits foreign flagged and crewed vessels from operating between USA ports which was created as protection for American owned and operated vessels.
