The argument can be made, but it isn't definitive as to whether or not it is a lawful order. I think a lot of lawyers would argue that it is not threatening.

They'll lose that argument. Cops legally give that command everyday all over the country. I know it's a little out there, but a lit cigarette can be used as a weapon.

Not even close to a lawful order. It was being used to establish dominance. the cop once again is getting what's coming to him.

A little common sense and courtesy on both of their parts would have resulted in two people being still gainfully employed.

Never heard of this story, can you or someone give a quick synopsis of the initial encounter?

The link is pretty vague mostly just saying there was an altercation, so it wasn't very helpful to know the exact issue without having heard of the issue before.
