Yeah, it's built "into" the only hill in town, and therefore has a strange multi-level floor plan.
This accommodation would be a giant pain in the arse.
He has his rights, and I support that. If it were me, I'd just go elsewhere.

You would think in a case like this, IF the government decides it needs to be upgraded, then there should be some sort of government grant that would assist in making the improvements. But our arse backwards way of doing things will be just shut it down and let everyone lose.

Bring back the epic Scott Alan Stagg and pack the place again.

Have an upvote with my complete agreement.
You are now seeing public swimming pools, including hotel pools, retrofitting with mechanical chair lifts to accommodate people with disabilities. And that's a good thing IMO.

Not understanding, If he lives downtown that means he has to pass in front of Dominos and Papa Johns on Johnston Street before he get's to Bisbano's. Probably save those batteries and tires from having to work so hard.
And Music, downtown must have more than a dozen places to go and listen.

What kind of friends don't help wheel you up the step?
Dude should be sueing his friends for no care.
Or maybe his "friends" go to Bisbano's specifically because he can't. Ever think of that Doylie?

His friends are the dicks here, they keep going where he can't.

How many hole in the wall restaurants would have to close if they start sueing all of them?
I feel for the person with the disability that just wants a pizza but this is getting ridiculous.

Is that entirely correct? I might be wrong, but I thought the grandfather provision required you to make some upgrades to the extent that you could (taking into consideration use, purpose, cost, etc.)
Found this on a quick google:
quote:
The ADA does not have a provision to "grandfather" a facility but it does have a provision called “safe harbor” in the revised ADA regulations for businesses and state and local governments. A "safe harbor" means that you do not have to make modifications to elements in an existing building that comply with the 1991 Standards, even if the new 2010 Standards have different requirements for them. This provision is applied on an element-by-element basis. However, if you choose to alter elements that were in compliance with the 1991 Standards, the safe harbor no longer applies so the altered elements must comply with the 2010 ADA Standards.
A “safe harbor” does not apply to elements that were NOT addressed in the original 1991 Standards but ARE addressed in the 2010 ADA Standards. These elements include recreation facilities such as swimming pools, play areas, exercise machines, miniature golf facilities, and bowling alleys. On or after March 15, 2012, public accommodations must remove architectural barriers to these elements listed above are subject to the new requirements in the 2010 Standards when it is readily achievable to do so.

quote:That's why I call bullshite. Who would repeatedly invite the guy to a place they know he can't go? And the only way to get him bathroom access would be to build one upstairs, so it's way out of the "reasonable" scope of the law.

What happened to being able to refuse service to anyone? It's your business.

You can't do it based off of race, religion, disability, etc. I can't stand people who have nothing better to do than go ruin someone else's life. Is not being able to roll into one place in town that big of a deal? If this guy does have to close his business I hope they run the plaintiff out of town.
