Big day for Louisiana Politics, JBE goes in front of judge re petition to limit powers

today jbe gets his day in court to argue against the petition that was filed to limit his powers during the emergency declarations. this was the one that was signed by the house members that should have ended his proclamation that he never even addressed.

this ruling could have long lasting implications over governors powers in Louisiana, if they rule the governor cannot be held in check by the other branches of our state government. of course with our liberal judges we have, its a good possibility JBE wins here.

I don’t see how he even has a case. The act is crystal clear on the limit of the governors powers. To rule in his favor effectively removes the checks and balances of the executive and legislative branches. That’s absolutely insane.

Let's hope some sanity will prevail for once. It's a virtual dictatorship if the governor can wield such emergency powers for such an extended time without the legislature being able to act as some sort of check on those powers.

In a time of ever growing governmental powers over people, it would surprise the hell out of me if anybody had their powers limited in government.

He can mandate all he wants, no one is following them
He can try to shut down businesses that don’t comply but with a Firehouse still open I’m not sure how that would work in his favor

Most "checks" of this power involve both the house and the senate, usually with a 2/3 majority, with the issue debated in the legislature.

Just the House with a simple majority, via a "petition"? I would not be surprised if that is struck down.

The GOP should have done this the proper way. But they didn't have the votes for it, because some of the GOP actually supports JBE.
