Imo, if you send it to a person's specific device you should expect it not to go past that device. If you broadcast it in a public arena then that is another issue.

Cops can send images as part of their investigation without facing criminal penalties. Likewise, you can take a picture of someone exposing themselves in public to aid in that person's criminal prosecution. If you punished people for taking the picture of the flasher/nudist then you would deter people from gathering evidence against the flasher.

We send confidential emails at work. We can sue if that info is shared outside of the intended group. Just because something is sent through an electronic process doesn't mean it is public information.

that is likely covered either by contract with the employee (who sent out the information) or property law covering trade secrets
it's nothing like this
remove the sensationalism and think about the general law here. use a non-nude example. what if somebody sends you a picture of their kids and you send that to somebody else. is that wrong? what if somebody sends you a picture of their house? new tv? clothing?
there is no difference in the these examples and "revenge porn" except content of the message. think about what kind of chilling effect this law has now. we're selecting groups of information that are now a FELONY to distribute. it's a terrible precedent and an afront to property laws
and no, i don't support people who spread nudes around, but when you send out a nude, it's not your picture anymore. it's his/her's

I agree. If you send it out, you have to accept any negative consequence.
It would be a problem if someone took a photo of you (in private) without your knowledge and consent and sent it out. But if you send it yourself I don't feel bad for you.

I think this law has more to do with people spreading a picture around and intending to inflicted shame or doing so to be malicious.
I may give or buy my husband a handgun but if he uses it to shoot me doesn't make what he did legal because I bought and gave him the handgun.
Farfetched I know, but kinda the same reasoning.
