Not against Sammy's, but against her. They aren't directly relating his ban to Sammy's to this incident. I'm sure they'll get more than enough people to back them up on him being intolerable about "his seat" at the bar

Considering she violated her probation by not paying back the $75k she stole from her employer, I think she would be hard pressed to sue for monetary damages.
How people can't see the motive she has to lie is beyond me. BTW, if she can't pay back the money she stole then why is she eating out at Sammy's? Has anyone asked that question yet?
