Pre-meditation is not an element in murder charges in LA
It can be considered to establish specific intent to kill or inflict great bodily harm for either 1st or 2nd degree murder but premeditation itself doesn’t have to be established.
The reason aggravated assault isn’t an aggravating factor to bump murder from 2nd to 1st is because it wouldn’t be murder if it was agg assault. Agg assault is (very basically) threatening to harm someone with a deadly weapon. The shooter actually DID harm sims.

This news conference is nothing but a pat on the back, look what we do, lets get more more tax money advertisement for these agencies.
ETA: This was solved by the community / tips and the shooter admitted to it but they didnt start talking about that until late in the conference.

The prosecutor will only be able to get manslaughter because Sims was the aggressor and its very believable the suspect feared for his life. This group of thugs were not attacking Sims. He took the fight to them and he is a 6'6" college athlete.
Sims was trying to be a hero, but his own actions escalated events. Its horrible, but any legit defense attorney will be able to prove who was the aggressor and that his size made him an extremely intimidating presence.

That’s not self defense. He will lose. That’s stand your ground, and this ain’t Florida. Being in a fight isn’t considered trying to flee, and from what I saw he did not try to remove himself from the situation.
Just because you get in a fight with a bigger guy doesn’t give you the right to use deadly force when he comes after you. I find it poetic justice that a generation of idiots who post their entire lives on social media like anyone gives two shits about them, so often get convicted of crimes because of that choice. Particular charges, jury decision, sentence doesn't really matter.
