There's gotta be some loophole for doing something in the heat of passion.

A father can't be expected to control himself when someone is trying to sexually assault his daughter.

Hopefully he can afford a good lawyer.

According to witnesses, Harris drove his car to a gravel area near where Armstrong was standing. He then allegedly got out and confronted the man before punching him in the face then stomping and kicking him repeatedly after he fell to the ground.

Well this changes things.

If I was on the jury he would be found guilty of Justifiable Homicide with sentencing of a statue being erected in honor.

There is. He could get off clean if he had a good lawyer.

There's no way he's getting off clean for murdering someone as described in the story.

So, the guy didn't get into the stall with the girl, just shook the door.

And the altercation took place later on in the parking lot.

Oh.. well... that changes things.

This is what happens when we let trans into whatever bathroom. I have no problem protecting my daughter.

I figure the guy wasn’t trans. But it could be a very similar situation happen if we allow that to happen

Even with your edit, this is still way off base in relation to the OP.

Reading the story, who knows if the guy was even trying to rape his daughter.

IIRC, you either have some specific amount of time, or a cooling off period. If you don't, it's not murder

Yep, in AZ, manslaughter is the appropriate charge for a heat of passion killing.

Looks like the DA went all out for 2nd degree murder, which is (1) intentionally causing death, (2) knowing that your conduct will cause death, or (3) under circumstances manifesting extreme indifference to human life, you recklessly engages in conduct that creates a grave risk of death and thereby causes the death of another person.

Guy will probably plead down to manslaughter.

I’m not saying he wasn’t at all.

If the father beat the guy to death while he caught him in the stall with his daughter, that’s pretty justifiable.

The way the article reads though makes it a bit more inconclusive.
