Yep, in AZ, manslaughter is the appropriate charge for a heat of passion killing.
Looks like the DA went all out for 2nd degree murder, which is (1) intentionally causing death, (2) knowing that your conduct will cause death, or (3) under circumstances manifesting extreme indifference to human life, you recklessly engages in conduct that creates a grave risk of death and thereby causes the death of another person.
Guy will probably plead down to manslaughter.

I’m not saying he wasn’t at all.
If the father beat the guy to death while he caught him in the stall with his daughter, that’s pretty justifiable.
The way the article reads though makes it a bit more inconclusive.
