The big difference between a 16-year old boy and a 16-year-old girl is that only one of them can get pregnant. Yeah, there's a group in society that wants to talk about 'pregnant persons' and such, but the real life-changing result is a kid having a kid. And just being real, having a kid affects the female a lot more than the male. So IMO there's a good reason why a 44 y/o guy banging a 16 y/o girl should be seen as worse than a 44 y/o woman banging a 16 y/o boy.

Even so, given the problems of pregnancy (and disease and others), IMO the law should say adults (anyone over 18) can't bang kids (anyone under 18) except where the age difference is no more than two years (no sense in making a criminal out of half of a high school couple that's doing it where one of them is 18 and the other 17).

At 44 this ... perp may be low risk for getting pregnant. Any time you can prove pregnancy was not a real risk, IMO the penalty ought to be less.

yeah. 44 year old and 16 year old. teacher and student. someone with way more power than the other. gonna go out on a limb and say the 16 year old is the victim. this isn't a van halen video. in real life, adults should be able to control themselves.

Every state has different laws but I'm pretty sure in LA there has to be a greater than 4 year age difference

Right, but that doesn't mean that an adult with years of experience and a fully developed brain should just give them what they want.

He may not be emotionally damaged but it's still predatory on her part.

That’s already illegal based on the teacher-student relationship. In Louisiana I think it is a misdemeanor.

Almost correct. In Louisiana, if one person is over 17 (not 18) and the other person is under 17 (not 18), then:

if the age difference is more than 4 years, then it's a felony under R.S. 14:80 (see https://legis.la.gov/legis/law.aspx?d=78672); and

if the age difference is less than 4 years but more than 2 years, then it's a misdemeanor under R.S. 14:80.1 (see https://legis.la.gov/legis/Law.aspx?d=78673).

I'm saying like most legal lines for being an adult, it should be 18 years old (not 17). I'm good with an age difference of less than two years making it not a crime.

That power dynamic changes. If you’re a teacher and you screw a student, he/she owns your arse. All they have to do is talk and you will end up fired, divorced, and in the the pen. Nothing will happen to them.
