Are employers required to provide personnel files to former employees upon request?

Depends what state you live in and what job you have. You'll probably get to see some things but not all.

If it’s a reputable organization you probably saw and/or signed every document in the file.

Medical by law yes, if employment is greater than one year, then time of service plus 30. Less than one year must request at time of termination.

It was once very reputable but not in last few years with new management. I no longer work there. Former fellow employee was terminated as a result of CV shutdown and has requested the personel file. The employer claims it is proprietary property and refused to provide it. All parties are in Louisiana. This was a 14 year employee.

I don't know I just make sure I hold onto my employees passports so they can't up and quit.

It varies.

I can say that I know a person who was in education, but not a teacher, who nearly sank a school district because they wouldn't give up their personnel file. In the end, it had been doctored and they were hiding a whole lot.

I understand your response.

But HR is there to protect the company.

Not the employee.

All I got.

Protecting the company.

Not the employee.

I understand your position, but HR is there to protect the company and senior management.

Not the employee.

It is wrong, but the unfortunate truth.
