Are dump trucks really not responsible for broken windshields?

I’ve seen most dump trucks have this posted on the back of their trucks, along with “stay back 500 feet.”

Are they not responsible for their loose cargo?

I'm sure you could probably win in court with proper evidence, but it'd be tough and probably expensive as hell. How would you prove they did it?

It's a total BS assertion intended to reduce claims. I don't think it has any basis in the law of Louisiana, and I'm not aware of that being the law in any other American jurisdiction (but I don't know for a fact). If something falls off of your vehicle and damages another vehicle, you are probably legally liable.

Our company just pays for the windshield. Cheaper and less hassle than fighting it. Good luck on a privately owned truck. 99% of the time it will be rocks falling from underneath because the quarry where they got the load, the wash system wasn't working. So, it's really the quarry's fault in that instance.

Now, if the driver left his tailgate unlatched, then he is liable.

Depends if windowshield is cracked because truck didn't secure load vs did truck's tire kick up a rock. As pointed out in earlier post, could be tough to prove.

Im pretty sure stuff falling off trucks are considered road hazards. Thus your problem.

Those signs do nothing when it comes to legal liability. It all comes down to whether you can make out a case for negligence or some other viable theory of liability.

I'm sure dash cams will help a lot in these situations. Especially if anything at all is wrong with the dump truck. Top tarp not secure, missing mud flap, etc. if there's anything at all wrong with that truck and you got it on hd video I think it's an easy win. Even if the truck is 100% legal and the video clearly shows a rock or debris coming off the truck and hitting your vehicle I think you have a case.

This is the more ridiculous thing to me. You want me to stay back 167 yards? 1 2/3 football fields?

I understand that distances on the interstate are deceiving, but telling people to stay back 500 feet and then pointing and saying "I had a sign!" is absurd.

Yes, indeed they are NOT liable. Many years ago the bastards got together and paid off some legislators to get an immunity bill passed that says under no circumstances do they have to pay. I think they only have to claim the back was covered with a tarp, but we all know that's usually bullchit too.

I ran into this years ago and was stunned to find out they were protected.

I'd look it up but I don't have time right now. Maybe tomorrow if nobody finds the law on it.

My buddy has several dump trucks. He always said if anything comes off the truck and hits somebody he is at fault, but if it touches the ground before it hits your car then it is considered a road hazard and he is not responsible. Not sure if that will hold up in court, but he has never paid for a windshield.

They are responsible for objects coming from their trucks, but not for objects coming from the road that were kicked up by their tire.

I love when they have the sign telling you in very small letters to stay back 300 feet. As if you can read it even 50 ft away. Or the ones that just say “do not follow.” I always laugh at those. What am I supposed to do if I’m going the same direction? Just stop and turn off at the next street whether I want to or not. I know what they mean but it’s so poorly worded.
