I sorta agree. At the least there should be a process where such situations could petition for it so the law is more reasonable either on one end or the other.

Doesn't matter. No one has a felony hung on them for simple possession first offense. He was either dealing, or he had multiple arrests, or there was a gun involved, or violence, or he couldn't stay clean through the diversion program.
