You think the homeowner asked the perp what kind of shorts he was wearing?
Your points have been horrific. You are parenting this is what happens
“Sir, please understand I am a drunk college student with my bathing suit on. I am walking towards you harmlessly”
Bang bang bang!

No, why would you assume that?
Should I be under the impression that your opinions on society are relevant or applicable in individual cases? Say for example, the one you're talking about.

Only one person there was a criminal. Now this scumbag attorney is going to break the victim, in civil court, just so he can make a paycheck. This, with him knowing the victim did not break a law.
Spare me the minstrels singing songs of what a wonderful SOB he is.
There should be a law saying the loser pays all expenses and legal fees of the people they frivolously dance through the legal system.

Insurance rates would go up 10 times because of all the legal fees they'd have to pay

Oh, no insurance. The scumbag attorney who harasses a victim can pay it out of his pocket. This would put a stop to trying to game the system, just for a paycheck, when you knew the person you were fricking over did not deserve it.

You obviously know him.
He’s not “a solid dude”, he’s a pos scum bag attorney trying to ruin someone’s life. frick your friend/family member for saying this below:

“We’re going to keep pressure on authorities to release the man’s name because if he did nothing wrong, there’s no need to protect him. There’s no need to shield his name,” Clemons said.

Did he also not have his hearing aids in? How could he not have heard the warning shot.

Sounds like the Speirs case.
DON'T LEAVE THE frickING HOUSE. WAIT FOR THE frickER TO BREAK IN BEFORE YOU SHOOT HIM.
This could be the case not being on the Jury and hearing the case.

Well that's dumb logic. I can carry my Kel Tec .32 even in gym shorts and people wouldn't notice.
We all know the ONLY reason this is even a story...

Hey may or may not be a good attorney but this doesn't sound like a "solid" dude. He knows EXACTLY what he's doing.
“Our unarmed client was brutally shot and killed by a homeowner in south Lake Charles on July 4, 2022,” Clemons’ office said in a statement. “Joseph Tezeno was a 21-year-old student at McNeese State University, and he did not have a criminal record. He was attending a college party in the area. He was a truly gentle soul. Unfortunately, he was intoxicated and inadvertently walked onto the wrong property. However, trespassing by a young black man should not result in a death sentence. All indications thus far are that this cold-blooded killing could have been averted. Joseph’s family and friends are still grieving and desperately seeking answers, which have been very difficult to obtain thus far."

I hope folks here think twice about running out of their homes if they find themselves in a similarly uncomfortable position.
I hope everyone dismisses your advice completely.

We don’t think he had his eye glasses on, he wore eye glasses. He went to this house by mistake.”

drunk college kid was trying to get into a house late at night. The homeowner heard it and went outside with a gun and told the kid to leave. The kid started advancing toward the owner so the owner fired a shot into the ground as a warning. The kid still kept advancing so the owner out of fear shot the kid.
If this is what happened then I see no way at all of the homeowner being at fault. It's an unfortunate situation, but being drunk isn't an excuse to immediately excuse all of your actions.
But the homeowner even giving him a warning shot is proof that he likely didn't want to kill the guy, but he kept walking forward and gave him no choice at that point.
I'll preface this by saying I've been drunk many times, and I've done stupid things, I have definitely nearly walked into the wrong apartment before. However, I would hope that someone pointing a gun at me would sober me up immediately.

Yea, I mean, my advice and the guy waits up a few mins with his weapon handy while waiting for the cops to come take him in for the night instead of actively entering a precarious situation.
Your take and you have a dead guy in your driveway, and a legal fight for your life that best case will drain your retirement fund.
Posted on 7/20/22 at 9:11 pm to NoSaint
Your take, and you better hope it's always a drunk kid in swim trunks.

You are saying that the landowner clearly could see no gun in his hand but a weapon could have been concealed. Yet he shot three times. That is going to raise some questions.

Something similar to this happened in maybe the 80s or 90s...maybe foreign exchange student on Halloween. Wrong house and got shot.
Posted on 7/20/22 at 11:39 pm to Bubb
Something similar happened in my city. A drunk guy got confused and started to try to break into a house - thinking it was his own. Homeowner shot him. Nothing happened to the homeowner, but it was a major story for a while.
I've been drunk many times but I've never attempted to break into anyone's home.
