There should be a law saying the loser pays all expenses and legal fees of the people they frivolously dance through the legal system.

Oh, no insurance. The scumbag attorney who harasses a victim can pay it out of his pocket. This would put a stop to trying to game the system, just for a paycheck, when you knew the person you were fricking over did not deserve it.

Hey may or may not be a good attorney but this doesn't sound like a "solid" dude. He knows EXACTLY what he's doing.

If this is what happened then I see no way at all of the homeowner being at fault. It's an unfortunate situation, but being drunk isn't an excuse to immediately excuse all of your actions.

But the homeowner even giving him a warning shot is proof that he likely didn't want to kill the guy, but he kept walking forward and gave him no choice at that point.

I'll preface this by saying I've been drunk many times, and I've done stupid things, I have definitely nearly walked into the wrong apartment before. However, I would hope that someone pointing a gun at me would sober me up immediately.

Yea, I mean, my advice and the guy waits up a few mins with his weapon handy while waiting for the cops to come take him in for the night instead of actively entering a precarious situation.

Your take and you have a dead guy in your driveway, and a legal fight for your life that best case will drain your retirement fund.

You are saying that the landowner clearly could see no gun in his hand but a weapon could have been concealed. Yet he shot three times. That is going to raise some questions.

Something similar to this happened in maybe the 80s or 90s...maybe foreign exchange student on Halloween. Wrong house and got shot.

Something similar happened in my city. A drunk guy got confused and started to try to break into a house - thinking it was his own. Homeowner shot him. Nothing happened to the homeowner, but it was a major story for a while.

I've been drunk many times but I've never attempted to break into anyone's home.
