Were pro-Russia and/or communists arrested on campus during the cold war?
Just wondering if this law has been used for supporters of "enemy" states in the past.

It would seem to be it should be protected speech.....EXCEPT when it gets into hate speech, which it inevitably would.
FWIW, I also think it should be legal for them to be firebombed while making said speech.

There was a case last year in Virginia where a kid was found on Twitter recruiting for people to go to Syria to fight for them. According to what I read, he was not prosecuted for the Twitter account b/c it was protected speech, but he *is* serving 11 years for actually helping someone make the journey.
I say "kid" because he was a high school senior. Apparently his parents found out and turned him in. Helluva thing to have to do.

is Isis still even a thing.

Ideas protected. Recruiting people to fight against the country not so much.

Interesting.

disagree. Directly inciting violence and terroristic activities is not protected.

So BLM can get away with it but ISIS cant?

The irony being that if a college or state bans ISIS recruiting on public campuses, the supporters will say it infringes on their constitutional rights,
"By gosh we HATE America and everything it stands for, except for the laws that protect our rights. But everything else is bullshite."

Simple enough. Should this be allowed?
Would not be allowed due to the patriot act I'm guessing

Is there a difference
No difference

The difference is that BLM wants to CHANGE our government institutions. I personally think they are misguided and bad people but I would die to protect their right to advocate for change. That is what makes the U.S. the greatest nation in history.
ISIS wants to DESTROY our government and country. Not protected and I will kill to stop them.
Two entirely different organizations.

treason isn't protected by free speech
The right answer

suppose they openly say they are recruiting for ISIS. Or standing in Free Speech Alley handing out pro-ISIS propaganda.
they would not get back to the parking lot alive once word got out what they were up to. they better not come back to the same campus two days in a row.
there are enough vets with serious ailments who would be willing to go out in a blaze of glory. snipers. automatic weapons.
if there were multiple ISIS volunteers doing this, we would have O/U wagers on how long they could stand there handing out pamphlets before the next one went down in a hail of gunfire.

Let me see that happen and Ill show them what fluid shock trama is all about.

No, not even close. Enlisting people to actively wage war against the country is not protected 1st Amendment 'speech.' Try again.

I think you should be able to say whatever you want in support of ISISbut as soon as that translates into material support (contributions, plotting attacks) then you are aiding an enemy of America and can be tried for the related crimes.

They would probably mop up on recruits at some of the Cal schools.
Posted on 3/17/16 at 2:55 pm to AnonymousTiger
No. It is a terrorist organization.
