If the shooter can articulate that he believed she was an intruder and his life was in danger....and his articulation meets the standard of being reasonable....then it would be justified.

Then if charged, the state would have to prove, beyond reasonable doubt, that he knew what he was doing.

The Oscar Pistorious defense. Didn't work for him, but apparently they were fighting earlier in the evening according to witnesses

I'm wondering why the daughter never spoke up. I'm sure she didn't want to get in trouble for sneaking him in, but when a gun comes out shite has gotten real. Own up to it at that point.

It was determined that Oscar's story did not fit the standard of being reasonable....also that is a different country with different laws.

I'm guessing she hid in her room and acted asleep with the hopes that the boy would not be found.

To the extent that a "stand your ground" law is conditioned on the person being an actual trespasser, it is very relevant.

This has nothing to do with Stand Your Ground. Castle Doctrine all day though.

The homeowner told deputies that his dog had begun barking, so he got his pistol and shouted for anyone in the home to come out. He says that when he checked the guest bedroom closet, a man ran out towards him and he fired once in self-defense. He says he later found out the intruder, now identified as seventeen-year-old Jordan Middleton, was a friend of his daughter's.

If this is true, the guy did nothing wrong.

If this is true, that kid and that daughter are fricking morons.

Both work. "Sneaked" was more common up until about 100 or so years ago, iirc. Matter of preference at this point (I prefer "sneaked" vs. "snuck" personally, but to each their own).

Does anyone know what the age of consent is in Georgia. If he was technically committing stach rape ( a felony) then it might also help the dad legally.

that girl's dad knew exactly who he was shooting

so this guy wakes up and finds someone in his house at 3 am and shoots him... but you think he woke up, figured out who he was, and decided to commit murder because he was meeting up with his young daughter?

No that wouldn't help.

Only thing that would justify it...is the intruder angle.
