I agree that most of these subs in the media world are simply selling footage. That is obviously a different deal. Im referring to if you are explicitly hired as an IC, for a specific job.

I understand and not the point I was getting at. Simply correcting you on your previous statement that was inaccurate.

I was saying if these guys are working independently with the intent to sell to the highest bidder than that bidder is not liable.

I already acknowledged that doesn't appear to be the case here, though.

TWC just sucks now, period. There was severe weather by me the other day and instead they were showing a dumb show about truckers. I want live weather.

So the guy killed was a storm spotter? Wonder what the difference is between spotter and chaser? I imagine the chasers get much closer.

Pattern of illegal, unsafe, behavior that was known on the part of the contractor while live streaming for TWC and you dont grasp the liability?

It will also be alleged this behavior was encouraged for ratings.

I agree that it seems twc needs to be penalized, but 125 is obviously a high # to settle a lot lower. Thing I dont like is that the lawyers will get the bigger junk of whatever it was that was settled for. Give the family 10 mil for their troubles. The lawyers 500k-1mil. And the have twc donate "X" amount as a penalty to something related without being able to "write it off".

This kind of shite is why our insurance rates keep going up, and have to deal with stupid lawyers pushing bad cases.

Well sure they condoned it. When you're standing in the middle of a hurricane dodging debris and shite while telling your audience to seek shelter - something doesn't add up.

It seems we agree. The difference is you referred to them as an IC, when in your example they would be more of their own company offering a service to the news outlets.

An employer is liable for the actions of their agents. Here, it appears that they were acting as agents of The Weather Channel given that they were providing video to be shown on the channel and were driving a vehicle carrying The Weather Channel logo, and The Weather Channel likely had some control of how they did the job.

Even if they're not your agent, you can be held vicariously liable for acts of your independent contractor when the independent contractor is engaged in an inherently dangerous activity.
