He can't and it's as simple as that. What they'll do is unlawfully harass you and possibly detain you in the prison without cause and they can safely assume our shitheaded judges and supine populace will just look the other way.

Both the gas station and walmart by my house were closed last night when I went by around 8 last night. Neither lost power or even came close to flooding.

Thankfully, my neighbor offered to go to the store for me today. Going from work to gonzales to take care of the horses means I'm in Baton Rouge well before curfew...

But after everything shuts down.

Do you even comprehend what you just posted? Is EBR still under a declared state of emergency? Simply having a mechanism in place for a lawful curfew to be enacted does not mean that by saying it is lawful it is automatically so. The conditions which can necessitate a lawful curfew are clearly not present currently.

I stopped in the parking lot of the AT&T store for a few minutes on Sunday to get wifi access to get in touch with family. Someone had broken in earlier.

Not denying that looting is or has occurred. But a parish wide curfew is not necessary.

ETA: As posted below, we are clearly still in a state of emergency, which gives the chief law enforcement officer of the political subdivision (the East Baton Rouge Parish Sheriff) the authority to enact a curfew. Am I missing something?

What do you mean link? When a cop pulls you over and writes you a ticket for speeding, he is employing a mechanism to enforce the speeding laws. If he were to do so despite you not having been speeding, it is not an action sanctioned by the law, despite his ability to carry that action out.

For frick's sake.


The only argument here is whether the Sheriff has any jurisdiction to establish a curfew within the city limits. They obviously have jurisdiction over the unincorporated parts of the parish.

Pursuant to such Sheriff orders curfew
