Right. Remember Michael Brown? "Witnesses" were all over the place. The good thing about this case is that there were at least 7 witnesses directly involved who have given statements, so they can see where the alignment is and begin to put together what actually took place.

You folks do realize that there are 3 eyewitnesses for the DA? The passengers in Smith's vehicle. The DA has a very strong case. Only thing that could change this is if the ballistic tests reflect another gun. If all 10 shots are from Hayes' gun, he's toast.

People keep saying this like its some huge distance
The skid marks are 15 ft meaning the brakes were on for 15ft not that there is 15ft between collision and final rest. Considering the cars were stopped a couplke of blocks away, that seems substantial to me. It's also substantial enough for the court of pendulum to establish that hayes didnt accident bump smith as they wrere both moving.... either:
A. Hayes rams smith intentionally
B. Smith slammed his brakes and made hayes ram him
That 15 ft is a huge part of evidence.

Don't you think unbiased witnesses' testimony who were on the scene will hold more weight?

When are the preliminary hearings? And how long until will we find out what was said in them?
Posted on 4/13/16 at 6:24 pm to GynoSandberg
If Fuller brings a witness saying the gun was moved after the shooting, amd he has impartial witnesses saying they saw smith with the gun, this case just took a huuuuge turn

Odds are there will not be a prelim. if grand jury indict first, no prelim.

Other than this description, Aaron never reported that one of Jamison's arms or his hand appeared or extended to be seen above the door. Any arm motion would have necessarily been hindered and obstructed by the door, the steering wheel and the partially closed window. Jamison's body was found seated, with his legs still below the steering wheel. Despite any abruptness of Jamison's motion, there was no demonstration by Jamison indicating that a weapon was drawn and was beginning to be extended around the steering wheel and above the window or that his body was suddenly turning with the door swinging open. Those movements had not begun, and yet Aaron clearly had his gun drawn and pointed at Jamison's head. Aaron did not testify that he gave any advance warning before shooting, not even by the sound of chambering a shell into his gun.
From the above evidence, the jury could conclude that Aaron was not presented with an imminent danger so as to justify a reasonable belief that the killing of Jamison was necessary to save himself from losing his life or receiving great bodily harm. Aaron had perceived what he believed to be a threat posed by Jamison and had initiated his defense by aiming his gun at Jamison. Jamison did not have "the drop" on Aaron. Aaron had the drop on Jamison and fired at a time when Jamison had not begun a threatening action from the confines of his car in which he was limited from posing a deadly threat.
All that was on top of a threat made by Jamison to Donald that, "I will kill you white boy."
did you also read where the jury discounted everything he said because he conspired to hide a witness and was caught telling lies multiple times. of course they wont believe him since there was no evidence that jamison made a threatening move, didnt have a weapon, he followed him down the road, he had no reason to believe jamison was dangerous, and the fact that he hid the fact that someone else was with him in the car that could have testified that what he said was true... but nice try. read it again.

Fuller saying Ceravolo had something to do with hiding Smith's gun is shitty but incredibly good lawyering.

Fuller is playing this thing perfectly.... DA should call up smiths lawyer and be like "wtf man". That press conference earlier was terrible and damaging imo to prosecution.

Idk how either is proved in court. I'm sure both sides will say something different
The guy who said 15 feet posted the pics of the skid marks

i really don't get these arguments. The Knights of Hayes have been dissecting the malicious bumper tap on Magazine, the disappearing 9mm, and now the "Smith caused the wreck" theory for days now.
These are pretty implausible ideas. Everything that has come out has looked pretty bad for Hayes. 7 entry wounds in Smith's back just to name one. Nothing even Fuller has said has justified the killing. What has some so skeptical?

Fuller looked giddy like that lawyer said some things this morning that are going to backfire on him.

He is publicly accusing an officer of tampering with evidence with no basis?
Tell us more about "good lawyering".

Not really. Everything that has come out has helped Hayes overall imo considering the initial report.

Idk either. Haven't seen those pics, they're definitely unimpressive.
The only evidence of first collision would be on back of hummer since smith hit car in front of him on second collision. However; the dent, if detectable, would be so minor, who is to say that there isn't 100 similar dents from other minor dings.
It's going to be hard for anyone to say with any certainty that any particular event took place, other than that which is on video or more than 1 consistent unbiased witness story.

With no basis? He says he has witness testimony

Interesting take considering "everything".

Hayes is toast. He shot a unarmed man. He will spend his days in Angola working on the farm.
