We're discussing speculation and he changes his speculation with every post. That's not a me issue. I do love that you try to always act like I'm the problem though.

Fuller just dropped huge POTENTIAL bombshell

If he has a written and recorded statement from bystander saying a gun was present with smith and then hidden, I don't see how the DA goes forward with the case

Always a possibility with NOPD I suppose. What's their position on body and dash cams? Hopefully that would help shed some light on this possibility. Not that we'd see it most likely.

I'm not sure if he was saying the responding NOPD hid the gun, or the cop friend of smith. It sounded like he could be inferring either

No lie detector test. But if there is an actual statement from a bystander witness, that is strong evidence

Fuller also said he had 4 other witnesses he will use at prelim hearings

Fuller clearly feels strongly about this case

Sounds like the witness is Hayes'passenger after the statement he gave yesterday. This isn't really anything new, it's just yesterday's statements reworded.

This is a Career defining case for him. He turned down the judge appointment for it.

No, the witness is not Hayes passenger. Fuller specifically said it is a bystander witness and a female

No Doubt, he doesn't turn down judgeship unless he's extremely confident he'll have a johhny cochran moment.

To me, unless some crazy provable fact comes out that we aren't expecting; this case rests entirely on the lawyers ability to say the right things. At this point, knowing what I know, it feels like a 5050 type deal to me. I'm resolved to the fact that we will never know for sure what happened, not that it matters, both parties contributed to a pointless death and it's just sickingly tragic.

Its a long process to fully vet a witness, take their sworn testimony and have them prepared to give sworn testimony in court, show up and give it in a court of law.
