You don't know the legal distinctions in Louisiana.
2nd Degree is extremely doable in this case.
If he DID shoot the wife first then shoot Smith, he is looking at First Degree.

what if this is the compartment that the lawyer was talking about. because this is a compartment in the vehicle

Bunch, what kind of lawyer are u? Seriously. The video from that twitter can't be any clearer regarding contact and both vehicles' reaction to contact. Fine that the case won't depend on that but open your mind up a little to be honest, if possible for a lawyer.

Again, I think he hit, but those are weak arguments. Any number of reasons. Maybe he THOUGHT he was hit. Maybe he wanted to make an insurance claim against Smith claiming an accident and get that chedda. Does he have a questionable past claims history?

In compartment = game over, Hayes is done
Not in compartment within reach of Smith = trial could be interesting, Hayes still likely done due to all the shots in the back, among other things

Looks like Smith flashes his lights at Hayes. Smith, aggravated that this guy is parked in the middle of the street, speeds off in front of him to try and make the light.
