Louisiana has Stand your Ground which does complicate that a bit, but I still think the prosecution would be in ok shape based on what we know.

But we need to wait for all facts to come out.

i think Smith was out of the truck arguing with Hayes and walked back toward his vehicle at some point. in a few of the nola.com pictures you can see his feet on the ground from behind the driver door as if he was leaning in the SUV when he was shot

I understand Louisiana's stand your ground rule complicates the issue. I did not mean for my post to seem like this was a cut and dry issue.

There still had to be the perception that they were in imminent danger and the use of force was reasonable, not excessive.

It also matters a great deal if Hayes pursued Smith in their cars prior to the collision. That would definitely hurt any 'stand your ground' argument.

Zimmerman may have started the altercation but Martin eventually got on top of Zimmerman and started punching him. That is reasonable fear for your life.

This A-hole (sorry I couldn't help it ) Shot him in the back when he was getting back into his car. Even if everything works in his favor, Smith hit him and than drove off, Smith got out of the car to argue, Smith was going into his car to get his gun. He still shot him in the back, that isn't self defense that is murder.

edit: don't turn this a Zimmerman argument, these are two completely different cases, Hayes life was never in danger (based on the evidence provided so far), Zimmerman's clearly was.

That lawyer becomes a Judge on May 2nd. He seemed very very sharp which means to me that a lot more will come out so we can't judge until all the info comes in.

I see manslaughter charges right now unless the NOPD produces the second gun per defendant's attorney that hasn't been produced.

there is no argument that can be made for shooting that gun 8 or 9 times like that. under the most extreme circumstances perhaps a single warning shot might be understandable. no matter what facts emerge, hard to imagine how pumping 9 rounds back to back to back like that is defendable.

Wow. Though I don't see the hummer jolting forward like it was actually hit. Plus, was Hayes trying to get hit? Such a crazy situation

If you had a gun and a guy you just had an altercation with is grabbing something like a gun, you wouldnt wanna make sure you are the one living after all?
