Forrest Gump: The Unanswered Questions

Forrest Gump has been on heavy rotation on HBO lately. I haven't watched it in many years but I found myself watching 2 times in the past week. If you can ignore the too often repeated one-liners that have become ingrained in pop culture, it is a really great movie. But I can't seem to shake two very glaring questions.
1) Why do people get all misty eyed when Jenny and Forrest finally hook up? She essentially rapes a retarded person, who I believe lacks the mental capacity to give lawful consent, and the audience is supposed to accept this. She manages to go back to Forrest after being a coke/heroin fueled whore and mooches off of him for the happiest days of his life. Where are Forrest's care takers, where are the good people of Greenbow that make sure this quasi-functioning mentally disabled person is not being taken for all he is worth? They clearly cared enough to give him a job cutting grass at the high school, so why don't they question Jenny's motives. Where is Lt. Dan? Wasn't he supposed to be watching out for Forrest's money? In my view, Jenny comes back seduces Forrest and lives off of his assets for a good while and then just leave town.
2) Someone please explain to me how Forrest and Forrest f*cking Jr. don't have AIDS? We are supposed to believe that a decade of intravenous drug use and promiscuity in the San Francisco and Los Angeles area in the late 70's/early 80's wasn't the cause of Jenny's AIDS but that she somehow got it subsequent to raping Forrest and cleaning up her life. Seriously? I have seen "And the Band Played On" there is no way she gets out of that West Coast lifestyle unscathed. Forrest and Forrest Jr. would most definitely have it. And if that is not good enough for you, are we now to assume that Forrest and Jenny didn't consummate their marriage? I will give you that there are scenario's where Forrest Jr. could have been protected from contracting AIDS from his mother, but there is no way that you are going to convince me that a simpleton such as Forrest isn't going to want get all up on some Jenny after they are married. The man has only had the sex once before, he clearly is going to want it again. The only probable answer is that Forrest Gump has AIDS or in the words of his mother, "Life is like a San Francisco bathhouse in 1982, you never know what you're going to get!"

Isn't is possible that Jenny got HIV after Forrest impregnated her and she had Jr.? She was already sick and had Jr. when they got married. I'm pretty sure that they didn't consumate the marriage because she knew by then she would pass it on to him if they did.

Of course it's possible but is it probable? She lives a questionable lifestyle on the West Coast in the AIDS hotbed of the late 1970's but instead contracts it in Savannah, GA working as a waitress. I just don't buy it.

1 you have to consider the timeframe. Forrest's mother protected him most of his life, and once he became wealthy he was accepted as being eccentric, as long as he was doling out the charity.
2 it appears Jenny got the Aids after her night with Forrest, which means Jr would have been born HIV free. Jenny would not let Gump hit that knowing he needed to be around to care for the boy

She has the sex with him and leaves...We don't know that she immediately went to Savannah. She could have gone back to Cali, had the kid, got the HIV, and then moved to GA before symptoms began to show.

The real "tear jerking" part when Jenny tells Forrest that the kid is his at the end has always really bothered me.
She knows shes sick, she wants to leave the kid with a good life, so why not lie to Forrest (a very mentally challenged multi millionare), so that her kid is set for life and no one will ever know and Forrest would never question her.
No way that kid is really his.

Forrest graduated from college and had a successful military career and then a very successful post military career. He didnt need caretakers he was slow but not retarded.

No.1.. You've got multiple questions in there but lets focus on his well being.. He wasn't retarded and was able to take care of himself just fine.. Was he prime for manipulation, of course but he stated that "we don't have to worry about money no more, that's good". It's easy to infer that Lt Dan was a custodian of his finances, ensuring that he had whatever he wanted but simply wasn't going to blow all his cheddar. Allowing Forrest to be Forrest and a philanthropist without worry.
