I think mitigating circumstances will take care of the waiver

I don't know yet. I don't think I can even begin to form an opinion without more info.

Tony is a very good driver, I have a very difficult time believing he would do something that could cause the car to act in a way he does not expect.

On the other hand, the idea he intentionally killed someone on an active race track is almost ludicrous. Probably more at play here than we know at the moment.

Yea your pit pass wavier doesn't clear you from from having charges filed against you, it clears the track of any liability should you die or get injured during the course of a race night.

No, I'd have to think he is liable if he hits someone outside of his car. He isn't in trouble for wrecking the guys car, he is in trouble for running a guy over.
