This question can be answered very easily.

Where was Stewart in relation to Ward's car. If ward's car was at the top of the track, and he was within 10 ft of it, and the rest of the field was down away from the scene while tony went up higher, he's guilty.

So if someone wanders onto the track and you intentionally hit him, you get off scot-free? I don't believe that.

I'm not saying that's what happened here, but I would think waivers are designed to prevent lawsuits in case of accidental deaths or injuries due to wrecks, not someone charging at you with the car.

No you get in trouble for that

The wavier only free's the track from liability. If a driver screws up its on them.

If you intentionally put somebody in the wall and they total their car, they cannot file suit against you to recover the damages. I don't know if it would be similar to that.

But you would have to think walking onto an active race track would mean something as far as being liable for you getting hit.
