The only way Stewart gets off is if he can prove that he absolutely tried to get out of the way and/or only saw Ward at the very last second. It seems unlikely that they can prove an intent to kill so unless Stewart can prove he was doing the right thing or unaware until it was too late, we're looking at some kind of manslaughter charge, voluntary or involuntary depending on New York state law and what evidence the prosecutors think they have that speaks to motive
This question can be answered very easily.
Where was Stewart in relation to Ward's car. If ward's car was at the top of the track, and he was within 10 ft of it, and the rest of the field was down away from the scene while tony went up higher, he's guilty.

Guarantee you're wrong.
Yeah, I would imagine that even if he is not in jail tomorrow, his people better be telling him to lay as fricking low as possible.

When you sign in to race you sign a giant waiver. Hence why even when people get injured in crashes no charges can be pressed. It'd be really hard for a prosecutor to make a case against him.
So if someone wanders onto the track and you intentionally hit him, you get off scot-free? I don't believe that.
I'm not saying that's what happened here, but I would think waivers are designed to prevent lawsuits in case of accidental deaths or injuries due to wrecks, not someone charging at you with the car.

i'd hope they would have the integrity not to approach the family about it
especially if the kid died
Was thinking that the family might want to issue a statement through someone.

No you get in trouble for that
The wavier only free's the track from liability. If a driver screws up its on them.

I think I would let the police handle it if I were them but that could just be me
would be the last thing on my mind in that moment

If you intentionally put somebody in the wall and they total their car, they cannot file suit against you to recover the damages. I don't know if it would be similar to that.

But you would have to think walking onto an active race track would mean something as far as being liable for you getting hit.
