This falls under involuntary manslaughter. If Stewart was "trying to intimidate" Ward but not kill him, he still gets about 2-5 years in jail. He would be "criminally negligent" in that case. If he intentionally tried to hurt Ward, that's voluntary manslaughter and he gets 10-20. If he intentionally tried to kill Ward, that's second-degree murder.
The only way Stewart gets off is if he can prove that he absolutely tried to get out of the way and/or only saw Ward at the very last second. It seems unlikely that they can prove an intent to kill so unless Stewart can prove he was doing the right thing or unaware until it was too late, we're looking at some kind of manslaughter charge, voluntary or involuntary depending on New York state law and what evidence the prosecutors think they have that speaks to motive.

If you run somebody over you aren't at fault. They are knowingly on a racing surface outside of a car. If you hit somebody in the pits for example, you aren't at fault.
Just a lot of specualtion. But you guys don't understand the waiver you sign. You basically have no rights while in the pits/on the track. At least accountable to the track.

Stewart should have quit the sprint track racing after his accident last year.

I can imagine a scenario where TS started to buzz this kid to scare him and then lost control or suffered some sort of mechanical failure. That's not completely out of the question at this point.
