My point is that the original comparison was off-base because a board member or CEO who says something stupid is typically an employee and not a major shareholder / owner.
In Sterling's case, he's considered to be a 1/30 shareholder of the NBA with hundreds of millions of dollars invested in a business.
The chances of pushing him out on a whim without legal redress are pretty small. And that's assuming you get about 23 other owners to vote him out considering that several have to be nervous about them being the next one in line to be targeted.

Interested in your take. You've seen pro-employee verdicts for management's racial comments made outside the work environment, to non-employees (or similar)? I've certainly never seen anything like that.
Now, considering we both work in this field and presumably you've been involved/around advising businesses, we'd likely both be concerned regarding the attempt to make out a hostile work environment claim, especially in an environment that gets a lot of press attention. That said, I don't think the claim would be ultimately meritorious, using our hypo here, which is what I assumed we were talking about.
