Legally, no. Now practically, you'd get fired or demoted, but the substance of a hostile work environment claim still isn't there.
I just don't like the idea of conflating moral and business premises in this case. It's a peculiar situation, but I wish there was more meat here to hang the punishment on.

ESPN is avoiding it because they obviously know the facts dont fit their agenda.

And I'm glad to hear it. I have no idea when it became borderline illegal to simply be an idiot or an a-hole. And I sure as frick don't like big organizations (like the NBA) trying to dole out punishments like these to someone who has personal beliefs.
Also, for clarification...what all is on the tapes? I know he was telling his super young girlfriend not to bring black people to the games and delete them off of her social media. Is that it? Sure, he comes off as prejudiced (not racist unless he hates all black people because they are black - which is key), but there's no reason he should be banned from the NBA for life. And this whole "making him sell" bullshite is..well, just that.
I haven't heard/read all of the tapes, but did he even say the N word? (And no, that isn't a prerequisite for racism, but I find it funny that most of the shite I've heard on the news and ESPN is him telling her to diassociate with "black people." Seems like a true racist would use different terms.)

Without the circumstances regarding that language being spelled out, I don't see how Sterling loses.
It sounds like the circumstances outside of financial difficulty are so limited that it would be extremely hard to invoke them.

I'm sorry, but yes. Combined with his past history, it is the perfect argument for a hostile work environment. I've worked cases with much less that have moved forward.
