This woman should be prosecuted for assaulting Mixon. Mixon had the right to stand his ground and walk away after stopping the assault.

Nah. She hit him at least twice. He hit her specifically to stop her from hitting him. This does matter, and I'm sure we all agree that Mixon will suffer far less punishment than if he dealt the first and only blow.

She pushed him, not hit him, then he faked a punch to her face and she reacted with a slap

That is what actually happened

Obviously her actions will cause his punishment to be far less than if he dealt the only blow. I hope that stupid bitch learned her lesson and stops assaulting people. Hitting people is wrong.

It's not irrelevant. In many cases the law holds you to a reasonable person. What kind of fear would a reasonable person have been in.

The OK statute doesn't even allow that

quote:

When committed either by the person about to be injured, or by any other person in such person's aid or defense, in preventing or attempting to prevent an offense against such person, or any trespass or other unlawful interference with real or personal property in such person's lawful possession; provided the force or violence used is not more than sufficient to prevent such offense;

I can't imagine how any jury could have found him not guilty, after seeing that video. There was no retreat, or attempt to retreat. And he basically hunted her down

Wrong she committed a battery. Once contact is made it is a battery. Assault is an attempt to commit a battery or the intentional placing of another in reasonable apprehension of receiving a battery.

So a person should not have a 6th amendment right to counsel?

She was mad about that so she got in his face, yelled back at him, and used a racial slur. then he threw the punch.

Ahhhh, you must have mistakenly missed the part where she hit him.

Not condoning what he did, but don't cherry pick information.

No. not even close to proportional response. You are factually and legally incorrect.
