Battery is a crime under Oklahoma law and can be either a misdemeanor or a felony.

Which she committed first.

Exactly!!!
I don't agree with what he did personally but, I could make a legal argument that justifies his actions.

Which she committed first.
Like if I rear-end somebody, but then the otj the driver assaults me in rage, can they not issue a traffic violation for the crash?

I'm too tired and TD is not billable hours! Lol

Your hypothetical only gave one crime. An accidental rear-ending is not a crime and, therefore does not have an affirmative defense.

Yes, it is an intentional tort and a crime.

This really makes no difference. Video shows guy following them inside and inserting himself in their business
Yep. He followed them inside and decided to escalate the situation. He decided to keep it real and needs to suffer the consequences.

I think she motioned him in

None of that is a crime of which is a crime.

He deserves the worst thing possible to happen to him.

My first thought, if you defend this POS I hope you die painfully.

death > getting punched > irrationally defending the puncher

I didn't say I hope that person dies, I just hope that when it happens...it's painful. Pay attention.

I agree with that. The difference in severity is pretty large though. His actions put her life in some danger. Hers were essentially annoying or rude.
Generally this kind of thing is harder for us to morally think through in an abstract sense. With a video like this almost all sympathy goes to the woman who was punched because the visual of her going down is so shocking and you feel concern for her welfare.
I suspect part of that is our innate sensitivity for the endangerment of women. If it were a frail man who first laid hands on a larger man (and was then laid flat) then I think many men and some women would argue he should have expected a possibility of exactly that response (essentially that he should have known better and was responsible for his outcome at some level).
But the difference in potential harm a large man faces when slapped by a frail man or a medium-sized woman is negligible - this shows our feelings may be gender based tendencies for sympathy for women rather than rational assessments of potential harm or impartial moral judgments.

It's all proportional. He over reacted disproportionally. It's a shame he isn't in jail. Obviously, he has self control issues and is probably a ticking time bomb.
If those of you defending him feel his response was warranted, I hope you'll be fine the next time you bump into someone while walking and he turns around and shoots you dead. Hey, you initiated contact first right?

Despicable.
Too bad it wasn't 100 years ago.

Look, hitting women is fricked up, and his life wasn't at risk, but it's kind of hard to expect someone to get slapped in the face/neck and not do anything.
You're an idiot if you think that his response was justified.
