There’s no way it’s not his kink. The photos look worse than Rihanna after Chris Brown attacked her. That isn’t something that occurs from a guy smacking someone’s arse for 5 seconds and calling her a naughty girl or whatever.
And if it’s consensual (which is damn near impossible to prove when it goes this far, without some detailed pre-written contract that Bauer clearly didn’t write), have at it.
However, the reports and photos are from the hospital. This isn’t some photoshop or he said/she said situation because there is a credible and neutral third party involved.
Bauer may escape jail time for this. But everyone is going to think he is a fricking lunatic, and the PR battle is more than half of the work for Bauer’s team.
Fwiw the fact that there is so much external damage versus internal damage (in a more classic sexual assault case like Kobe’s) is probably worse for him, not even factoring in changing cultural attitudes.

However, a setup does in no way entitle him to punch someone who is unconscious or sleeping.

WTF??? Obviously, this younger generation watched too much 50 Shades, if that's the norm now. Maybe too much porn. A bit shocking to me to think that so many out there think choking is ok. Absolutely. I remember hearing about deaths in the news many years ago. However, I'm guessing that it's a lot more common than it used to be. I think young girls and women see things like this and just believe it's expected, so many (not talking about this crazy one!) agree to things that really don't want to do because they've seen in on the big screen or on internet porn.

I wasn't making a value judgment on it. If I were to, I'd probably lean more to your opinion. But yeah, choking is really common (in relationships too). I'm sure porn does play an influential role. I've wondered about this a lot -- if women have always been like this or if porn and other environmental factors are contributing. I'd guess a mix of both?

How many of you would or have said you would take $5 million to get in a ring with Tyson knowing you would get your arse beat?
The only difference between this and a fight with Tsyon is she used her womanly ways to guide him to do the things he did. She told him she loved rough sex and so on. It peaked his interest so he went along with it without realizing she wanted him to beat her arse for a pay day.
For the record there are a lot of women out there who love rough sex. I have been with a couple who like being slapped and so on. Granted slapping a woman in the face is much different then punching, but we dont know for certain what this chick said to him in person. IMO she probably was asking to be punched and so on knowing full well millions was the payoff.
